What Every Lawyer Needs to Know About Immigration Law

Kate Kalmykov focuses her practice on business immigration and compliance. She represents clients in a wide-range of employment based immigrant and non-immigrant visa matters including students, trainees, professionals, managers and executives, artists and entertainers, treaty investors and traders, persons of extraordinary ability and immigrant investors.

Kate has extensive experience working on EB-5 immigrant investor matters. She regularly works with developers across a variety of industries, as well as private equity funds on developing new projects that qualify for EB-5 investments. This includes creation of new Regional Centers, having projects adopted by existing Regional Centers or through pooled individual EB-5 petitions. For existing Regional Centers, Kate regularly helps to prepare amendment filings, file exemplar petitions, address removal of conditions issues and ensure that they develop an internal program for ongoing compliance with applicable immigration regulations and guidance. She also counsels foreign nationals on obtaining greencards through either individual or Regional Center EB-5 investments, as well as issues related to I-829 Removal of Conditions.

Moreover, Kate also works with various human resources departments on I-9 employment verification matters as well as H-1B and LCA compliance. She regularly counsels employers on due diligence issues including internal audits and reviews, as well as minimization of exposure and liabilities in government investigations.

Jill E. Family is Commonwealth Professor of Law and Government at Widener University Commonwealth Law School and is Director of Widener’s Law and Government Institute. At Widener, Professor Family teaches Immigration Law, Introduction to Immigration Law Practice, Administrative Law and Civil Procedure. She has a longstanding interest in government law that influences her teaching and her scholarship. She holds a joint degree in public policy (MS) and law (J.D. high honors) from Rutgers University, and a degree in history (cum laude) from the University of Pennsylvania.

Professor Family is known internationally for her work exploring the links between immigration law and administrative law. In addition to many US law journals, she has published in British and Spanish law journals. She was a Visiting Scholar at Queen Mary School of Law in London.

Additionally, Professor Family served as a member of the governing council of the American Bar Association’s Administrative Law Section. She is a Fellow of the American Bar Foundation and she was the 2010 Fellow of the National Administrative Law Judiciary Foundation. She testified before a US Senate Judiciary Committee subcommittee on issues at the intersection of administrative law and immigration law.

Jennifer Hermansky focuses her immigration practice on both employment-based and family-based immigration. Jennifer has experience serving health care, pharmaceutical and real estate industries, as well as entrepreneurs, scientists and researchers in scientific communities. She represents clients in a wide range of employment-based immigrant and non-immigrant visa matters including students, professionals, managers and executives, artists and entertainers, treaty investors, individuals of extraordinary ability, and immigrant investors.

Jennifer concentrates on EB-5 immigrant investor visas. She has prepared and filed many I-526 petitions and I-829 petitions for immigrant investors, both through individual investments and regional center investments. Additionally, she regularly works with developers across a variety of industries seeking capital for new projects that qualify for EB-5 investments. She counsels clients on the creation of new Regional Centers, amendments of a Regional Center designations and adoptions of developer projects by existing Regional Centers. Jennifer also regularly counsels approved Regional Centers on an ongoing basis, including job creation issues and Regional Center management recordkeeping and staffing issues.

Anna Williams Shavers is the Cline Williams Professor of Citizenship Law at the University of Nebraska College of Law.

She received her J.D. degree (cum laude) from the University of Minnesota where she served as Managing Editor of the Minnesota Law Review. She was admitted to the Minnesota Bar in 1979 and the Nebraska bar in 1989. Other positions include: Associate, Faegre & Benson Law Firm, Minneapolis, MN and Associate Clinical Professor, University of Minnesota. While at the University of Minnesota, Professor Shavers established that law school's first immigration clinic. Professor Shavers teaches Administrative Law; Immigration Law; Forced Migration (including Human Trafficking); International Gender Issues; and Gender, Race and Class.

She currently serves as Co-Chair of the University of Nebraska-Lincoln Interdisciplinary Conference on Human Trafficking Planning Team, and a Public Member of the Administrative Conference of the United States (ACUS). She has previously served as Chair of ABA Administrative Law Section, the Secretary and Publication Chair, a Council Member and Immigration Committee Chair of the ABA Administrative Law Section, Chair of the AALS Section on Immigration Law, member of the ABA Commission on Law and Aging and member of the ABA Coordinating Committee on Immigration Law. She is a frequent national and international presenter on immigration, human trafficking and administrative law issues.
