Law firms and their clients across industries are seeing a significant increase in cyber incidents. Leveraging familiar eDiscovery and Analytics tools can be an integral part of effectively responding to these incidents. However, it is imperative to understand what makes these matters unique (including scope and workflow) to ensure a strong and defensible outcome all while often under time and cost pressures.

During her more than 15 years in the industry she has focused her expertise in the development and implementation of defensible programs for litigation teams. She is a proud graduate of Temple University and Certified E-Discovery Specialist.

Sumera Khan is a partner in the Houston office where her practice focuses on eDiscovery and information governance, data privacy, and commercial litigation. She has counseled clients in the energy, healthcare, insurance, and pharmaceutical industries on issues arising from litigation as well as requests for compliance advice.

Sumera assists clients in navigating complex electronic discovery issues, and during the past three years, Sumera has developed a particular specialty to efficiently and defensibly respond to cyber incidents by preparing review protocols designed to quickly identify data subjects impacted by the incident and the types of personal information impacted. Sumera has counseled clients not only on incident response and regulator notification but also on breach preparedness.

Following two separate secondments to the corporate office of a leading specialty insurer, Sumera has also maintained her commercial litigation practice where she has defended clients in insurance coverage litigation, class action suits, and various other disputes. She is known for her knowledge and appreciation of the client's business operations and interests and for formulating strategies that best serve those interests.

As the Global Lead of Cyber Incident Response Services and senior member of Consilio’s Client Services team, James focuses on helping clients and their counsel develop and implement effective strategies based on the needs of their matter.

With more than a decade of legal and eDiscovery experience, James has consulted on and managed highly complex engagements for clients across a range of industries including the financial, insurance and technology sectors. As the Global Lead for Consilio's Cyber Incident Response Services, James uses this expertise to assist clients impacted by a range of cyber incidents including Business Email Compromise, Ransomware and Data Exfiltration. Working hand in hand with clients, their breach counsel, and cyber forensic firms, James and his team offer clients a range of services when responding to a Cyber Incident including data collection and hosting, analytics-driven data mining, document review, and notification report generation.

Ellen Blanchard

Director of Discovery & Information Governance

As Director of Discovery and Information Governance at T-Mobile, Ms. Blanchard leads a team of experts who with the business to develop sound information governance best practices and respond to government inquiries and complex litigations. She uses her deep knowledge of the intersection of litigation, technology and discovery to work with all areas of the legal department on document retention and preservation, collection and review issues. She participates in several enterprise wide groups tasked with strategy decisions related to implementing new technologies and systems.

Prior to joining T-Mobile, Ms. Blanchard was a litigator at Boies, Schiller & Flexner LLP, where she represented several Fortune 50 companies in a variety of complex litigation matters as national eDiscovery Counsel. She also spent 2 years as Associate General Counsel and Director, eDiscovery Consulting at Evolver Legal Services where she counseled core clients to develop litigation plans that included negotiating the scope of discovery as well as conducting early case assessment and understanding the options for review, including technology assisted review.

Ms. Blanchard earned her J.D. from American University, and Bachelor's degrees in International Business, Japanese Studies and Psychology from Ohio Wesleyan University. She is admitted to the Washington State Bar and Virginia Bar. An active member of Sedona and Women in eDiscovery and a frequent speaker at eDiscovery conferences, Ms. Blanchard enjoys talking with others about Discovery Best Practices and sharing war stories.
